Terms of Service

These terms cover your use of Frankie. In short: you own your content and are responsible for how your assistants are set up and used on your sites. We run the service with care but can’t promise AI answers are always right. Paid plans renew until you cancel.

Privacy PolicyTerms of Service

Operator details not set. This deployment hasn’t configured who runs it. Set FRANKIE_LEGAL_NAME, FRANKIE_LEGAL_JURISDICTION, FRANKIE_LEGAL_EMAIL in its environment to complete this page.

The agreement

These terms are an agreement between you and the operator of this Frankie service (“we”, “us”) for the Frankie website, dashboard and hosted service (the “Service”). By signing in or using the Service you accept them. If you use Frankie for an organization, you accept them for it and confirm you’re authorized to do so. Our Privacy Policy explains how we handle personal data and is part of these terms.

The service

Frankie lets you build AI assistants (“agents”) for your app, website and docs, and add them to your product. Agents answer questions, read your knowledge base, take actions through APIs you connect, and hand conversations to your team. We may change, add or remove features. If a change materially reduces what a paid plan includes, we’ll tell you in advance.

Your account

You sign in with GitHub and must keep that account secure. You’re responsible for what happens in your workspaces, including what teammates you invite do there. Keep your workspace secrets private. Contact us right away if you think your account or a secret has been compromised.

Your content and your visitors

You keep all rights to what you put into Frankie: instructions, knowledge-base pages and files, API descriptions, and your visitors’ conversations (“Your Content”). You let us host, process and transmit it only to run the Service for you, including sending it to the AI model provider your workspace uses. We don’t use it to train models.

When you put a Frankie agent on your site or app, you’re responsible for your visitors. That means you must:

  • have the rights and permissions needed for Your Content and for the data your agents handle;
  • tell visitors in your own privacy notice that you use an AI assistant provided by a third party, and get any consent the law requires;
  • only connect APIs and data sources you’re allowed to use, and only let agents act in ways your visitors would expect.

For visitors’ personal data, you’re the controller and we process it on your instructions.

What agents do

Agents generate answers with AI. Those answers can be incomplete, out of date or wrong. Agents take only the actions you allow, as the signed-in visitor, through your APIs. You choose those actions and are responsible for the results, so test them and limit risky actions to what you’re comfortable with. Pull requests Frankie opens in your repositories are proposals: review them before you merge.

Acceptable use

Don’t use Frankie to:

  • break the law or infringe anyone’s rights, including privacy and intellectual property;
  • deceive people, for example by presenting an agent as a human when asked, or by impersonating someone;
  • harass, threaten or harm people, or create content that sexualizes minors;
  • send spam or malware, or attack, probe or overload the Service or anyone else’s systems;
  • get around rate limits, plan limits or security controls, or access another customer’s data;
  • make fully automated decisions with legal or similarly significant effects on people (such as credit, employment or housing) without meaningful human review;
  • break the usage policies of the AI model provider your workspace uses.

You may not resell the hosted Service or use it to build a competing service without our written permission.

Plans and billing

Frankie has a free plan with limits and paid plans billed through Stripe. A paid plan renews automatically each period at the price shown at checkout until you cancel. You can cancel at any time in the billing portal, from Billing. Your plan then stays active until the end of the period you’ve paid for. Fees are non-refundable except where the law requires otherwise. Prices don’t include taxes unless stated. If a payment fails, we may limit paid features until it’s fixed. We’ll give you notice before changing the price of your plan.

Other services and open source

Frankie works with services we don’t control, including GitHub, Vercel, Stripe and AI model providers. Your use of them is governed by their own terms. Frankie’s SDK package is open source under the MIT License. That license, not these terms, governs the package itself. These terms govern the hosted Service.

Suspension and ending

You can stop using Frankie at any time and delete your workspaces from their Settings. We may suspend or end your access if you seriously or repeatedly break these terms, if your use creates a security or legal risk, or if we have to by law. Where reasonable, we’ll warn you first. If we end the Service as a whole, we’ll give you reasonable notice and refund any prepaid fees for the unused period. After your access ends, we delete your data as described in the Privacy Policy.

Disclaimers

To the extent the law allows, the Service is provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Service will be uninterrupted or error-free, or that AI output will be accurate.

Limitation of liability

To the extent the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims about the Service is limited to the greater of what you paid us in the 12 months before the claim and US$100. Some places don’t allow these limits, so they may not fully apply to you. Nothing here limits liability that can’t be limited by law.

Indemnity

You’ll defend and indemnify us against third-party claims arising from Your Content, your agents’ configuration and actions on your systems, or your breach of these terms. We’ll tell you promptly about any such claim and let you control its defense.

Changes

We may update these terms. We’ll post the new version here with a new date. For material changes, we’ll tell customers in the dashboard or by email at least 14 days before they take effect. If you keep using Frankie after that, you accept the new terms.

Governing law

These terms are governed by the laws of the place where the operator is established, without regard to conflict-of-law rules. Disputes go to its courts, unless the law where you live gives you the right to bring them locally. If any part of these terms can’t be enforced, the rest still applies. These terms are the whole agreement between us about the Service.

Contact

Questions about these terms: contact the operator of this Frankie service through the contact details the operator publishes.
